The Shevchenkiv District Court of Kyiv, under the leadership of Yevhen Martynov, tried to transfer the case of former lawyer Tetyana Montyan to the Selydiv City Court of the Donetsk Region. Martynov justified this by the fact that the crimes of which Montian is accused were committed in the temporarily occupied territory of Ukraine, in particular in Donetsk, and therefore the case should be considered by the court of Donetsk region. However, the Kyiv Court of Appeal did not agree with this position.
The Kyiv appeal indicated that Montyan's charges relate to her public appearances on Russian propaganda TV channels, in particular on Vremya pokashet, and her activities in the media, in particular on the YouTube channel, where she called for changes to Ukraine's borders, justified Russia's armed aggression and supported the actions of the state - the aggressor There are no direct indications in the indictment that these actions were committed in Donetsk. The fact that she spoke on the "Union" TV channel controlled by the "DNR" does not mean that the crimes were committed in a specific place, as the head of the Shevchenkiv district court insisted.
Therefore, the appellate court decided to return the case to the Shevchenkiv District Court of Kyiv for further consideration.
The history of the case of Tatiana Montyan
Tatyana Montyan is a former Ukrainian lawyer with pro-Russian views. After the start of Russia's full-scale war against Ukraine, she actively appeared in the Russian media with anti-Ukrainian statements, denied Russian aggression and supported the Kremlin's decisions. In March 2023, the Office of the Prosecutor General of Ukraine charged her with four articles of the Criminal Code, including public calls for the overthrow of the constitutional system of Ukraine, changing borders and justifying war.
In addition, in September 2024, the Qualification and Disciplinary Commission of the Bar of Zhytomyr Region terminated Montyan's right to practice law.
