Employees of the State Bureau of Investigation (SBI) discovered a scheme to evade mobilization through a fictitious divorce and establishment of custody of children, organized by an assistant of one of the judges of the Mariinsky District Court of Donetsk region. As it became known, the organizer of this criminal mechanism was a former law enforcement officer who, for $3,000, ensured the adoption of court decisions that allowed men to avoid conscription.
The fictitious process included the divorce of the husband and wife and the deprivation of the woman's parental rights, which made it possible to establish the fact of independent upbringing and maintenance of the child. Real lawsuits were not filed in these cases, and the men received ready-made court decisions after paying for the services of a judge's assistant. Such decrees unjustifiably gave men the opportunity to get a deferment from mobilization and go abroad.
The SBI has already informed the judge's assistant about the suspicion of committing a criminal offense provided for in part 3 of Article 332 of the Criminal Code of Ukraine, which provides for responsibility for the forgery of documents aimed at evading mobilization.
In addition, law enforcement officers are investigating the involvement of other court employees in the crime, in particular the judges and management of the Marinsky District Court, and are investigating possible abuses at other levels.
