Lawyers for the famous Italian luxury lifestyle brand Stefano Ricci , headquartered near Florence, have filed a lawsuit against the owner of the Domino chain of stores, Anton Shukhnin. He is accused of misappropriation of the trademark. This is reported by the editorial office of 368.media , citing the rulings of the Commercial Court of Kyiv.
The lawsuit by STEFANO RICCI SPA against the State Organization "Ukrainian National Office of Intellectual Property and Innovations" and Anton Shukhnin. The Italian company demands:
-
to declare invalid the certificate of Ukraine No. 181419 in respect of all goods and services, since the trademark "STEFANO RICCI" under this certificate is identical to the international registration No. 767523, the validity of which extends to Ukraine;
-
to invalidate certificate No. 181419 , as it may mislead consumers as to the origin of goods and services, as well as the person who produces them.
The case is being considered by judge Oksana Blazhkivska of the Commercial Court of Kyiv.
Anton Shukhnin has been known for several years as a so-called “patent troll.” According to court records, he systematically attempts to register rights to luxury — with the obvious goal of profiting or blackmailing copyright holders.
His activities have repeatedly become the subject of legal disputes. Previously, Italian companies Stefano Ricci SPA and Jacob Cohen Company SPA have already filed lawsuits related to his actions.
In the case of Stefano Ricci, the proceedings were left without consideration, while in the dispute with Jacob Cohen, Shukhnin initially achieved registration of the trademark in his own name, but later lost in another lawsuit - the court canceled his certificate No. 199402 for the mark JACOB COHEN .
Lawyers note that such attempts at "brand raiding" discredit the Ukrainian intellectual property protection system and create risks for the country's international image.
