The assistant of the Kiev notary will be tried for an illegal certificate of more than 1500 documents on behalf of the manager, which has been abroad since 2022. According to the investigation, it performed notarial acts without proper powers, using access to official forms, seals, digital signatures of the notary and notarial registers of the Ministry of Justice of Ukraine.
According to the Kyiv City Prosecutor's Office, the assistant is accused of entering false data in notarial registers, which is a violation of Article 361, paragraph 5 and part 3 of Article 358 of the Criminal Code of Ukraine. It provides for a penalty of up to 15 years in prison, as well as a ban on holding certain positions for up to three years.
The investigation found that a notary who worked in the Kyiv City Notarial District from February 2022 was abroad and instructed his assistant to perform notarial acts. She had access to all documents and registers necessary for certification, which allowed her unauthorized to carry out more than 1500 notarial acts.
Despite the fact that clients were not suspected of fraudulent documents, the investigation found that all these actions were illegal. The case is now transferred to the court, which will determine the further extent of the assistant, and the issue of the notary who is abroad and is already the object of separate criminal proceedings is resolved.
