The Shevchenkivsky District Prosecutor's Office of the City of Kyiv, through court, has returned to state ownership of a land plot of nearly 7 hectares in the Solomenskiy district of the capital. The estimated cost of the site is about UAH 190 million.
This was reported by the Kyiv City Prosecutor's Office.
According to prosecutors, the site was transferred to the permanent use of the State Emergency Service of Ukraine (SES). At the same time, it was actually used by private companies that had no legal grounds for it.
Moreover, no objects belonging to the SES were discovered in the territory. All this indicates the abuse of the right of permanent use by the formal user and the real commercial use of state land by private land.
Given the detected violations, the prosecutor's office appealed to the Commercial Court of Kyiv with a number of requirements:
-
terminate the right to constantly use the land;
-
return the plot to state property;
-
cancel the KSCA's order on the division of this area;
-
To declare invalid state registration of 13 newly formed land plots in the State Land Cadastre.
The court fully satisfied the claim, recognizing the use and redistribution of state land illegal.
