The Khmelnytsky Court of Appeal ended a case of a woman who in December 2024 ran into a police officer during a summary.
The incident happened on December 11, 2024 in the yard of an apartment building. The local resident was approached by a senior police officer and representatives of the Tax Code and the JV with a request to present documents. The man reported that the documents were in the car, then sat on the passenger seat of a parked BMW and closed inside.
Subsequently, his wife came to the car, who sat at the wheel and started traffic, despite the fact that a police officer stood in front of the car. She ran on him, causing light bodily harm.
The Khmelnytsky City District Court found the woman guilty under Part 2 of Art. 345 of the Criminal Code of Ukraine - deliberate causing a law enforcement body to a law enforcement agency in connection with the performance of official duties. However, given the request of the Labor Collective of the FOP, where the defendant works as a cutter, she was released from criminal liability, transferring to bail, and the proceedings were closed.
However, the court decided to confiscate the BMW-520 car, which belongs to a woman and was used as an instrument of crime. The defendant's lawyer appealed this decision, arguing that deprivation of transport will limit the woman's ability to keep her family and take care of her mother. It was also noted that the police himself, they say, hindered the movement.
However, the Khmelnytsky Court of Appeal did not grant the complaint. The panel of judges confirmed that the confiscation of the car is legal and does not violate the principle of fair equilibrium between the interests of society and the individual.
"The car was used as an instrument of a deliberate crime against a law enforcement officer during his participation in mobilization activities during the martial law," the decision reads.
