PrivatBank won the lawsuit regarding a loan for 200 thousand: the debtor claimed that he did not know about the contract

The Arnitsky District Court of Kyiv considered a dispute between PrivatBank and a man who demanded to declare a loan agreement concluded in August 2022 invalid. The financial institution insisted on collecting the debt in the amount of 156,773 hryvnias, while the borrower claimed that he actually received the loan by mistake and without realizing the consequences.

According to the case materials, the man signed a statement of adherence to the bank's terms and conditions when issuing a military personnel's salary card. The bank employee simultaneously issued him a Universal Gold credit card with a limit of up to 200 thousand hryvnias at 40.8% per annum. The borrower claimed that he perceived it as an advertising bonus and did not realize that he was actually taking out a loan. Later, he used the funds for the needs of the unit and treatment, but claimed that he had no intention of concluding a loan agreement.

The man filed a counterclaim, demanding that the contract be declared invalid, citing formal violations in its conclusion and a lack of clear understanding of the terms. He noted that the branch employees misled him, convincing him that he was signing only to receive a salary card.

The court, having analyzed the account statement, established the fact of using the loan funds: cash withdrawals, account replenishment, and expenses for personal needs. This, in the court's opinion, confirmed the actual receipt and use of the loan, as well as the existence of outstanding debt.

The bank representative informed the court that the amount of the debt during the review process had decreased to 145,005 hryvnias due to partial payments by the defendant. The court found this data proven and supported by documents.

The husband's counterclaim for invalidation of the contract was dismissed. The court emphasized that the bank had fulfilled its obligations and the borrower had voluntarily carried out credit card transactions, which is confirmation of the actual conclusion of the credit agreement.

Thus, the court ruled to recover 145,005 hryvnias from the man in favor of PrivatBank.
