The Court of Appeal of Kiev left the decision to demolish a restaurant, arbitrarily built on the territory of the Holosiivsky National Nature Park. We are talking about an institution that worked under the names "Tandir" and "Kuvshin", and which belongs to the former head of the Svyatoshinsky district police department of the capital Anatoly Nikolayse.
According to the Informant, the court confirmed that the building is located within the nature reserve fund without any legal justification. According to the Kyiv City Prosecutor's Office, the construction was carried out without a proper decision of the Kyiv City Council, and documents for land ownership were issued in violation.
According to the court decision, the premises must be dismantled and the site is returned to the community of Kiev. The decision of the first instance was made on October 10, 2024, but the owners of the restaurant tried to challenge it.
According to the OPENDABOT service, by December 2022, the only beneficiary of the restaurant business was Anatoliy Mykolaets - a former police officer and taxman who is today an assistant to the People's Deputy from the faction of the "servant of the people" Mikhail Novikov.
During the consideration of the case it was found that the registration of land ownership was carried out with the help of false documents. The scheme includes two state registrations - Snizhana Avramchenko and Victoria Kendzora. It was they who issued documents that allowed to legalize the building in the protected area. In the future, Avramchenko held a position in the office of counteracting the raiding of the Ministry of Justice.
Particular attention should be paid to the strange scheme, according to which the legal rights to the land have been transferred to LLC "Comfort and KO". The reason for the transfer was the decision of the Bryankiv City Court of Luhansk region in 2010-a city that has been occupied since 2014. Because of this, it is impossible to check the accuracy of the decision.
Thus, the court finally recognized the self -construction in the security area of the National Park, and the prosecutor's office stated that the decision to dismantle the decision would seek.
