Lawyer Roman Kychko explained in detail the procedure for imposing fines on conscripts for administrative offenses related to mobilization. According to him, this process somewhat resembles a court case, but has specific features provided by legislation.
Kichko noted that the fine can be imposed only by the head of the territorial procurement center (TCC), and this takes place in the premises of the TCC. "The head of the TCC acts as a kind of judge in such a situation. He examines the case materials, analyzes the evidence and passes a decision on bringing to administrative responsibility," the lawyer explained in an interview with "Ukrainian Radio".
Who has the right to impose a fine?
Kichko emphasized that the imposition of fines for administrative violations related to mobilization is not within the powers of the police or the court. Only the head of the TCC has this right. The procedure is regulated by the Code of Ukraine on Administrative Offenses, which also defines the requirements for drawing up a protocol and a resolution on a fine.
"A person has the right to appeal the imposition of a fine, therefore the general norms regarding administrative offenses remain in force," the lawyer added.
Postponement of mobilization: key points
Against the background of a full-scale war in Ukraine, mobilization continues, and some categories of citizens have the right to a postponement. Roman Grunda, assistant to the head of the TCC of Ternopil region, explained that the presence of the right to postponement and supporting documents does not guarantee its automatic grant. Conscript deferment is granted depending on family circumstances, health, education or professional activity.
