The Rivne District Administrative Court ruled in favor of the former senior assistant of the prosecutor of the region Lyudmila Moroz and abolished restrictions on her pension. Thus, the court restored her payments in full - UAH 52.9 thousand on a monthly basis, which were reduced to 31.7 thousand in accordance with the Cabinet Resolution No. 1 of January 3, 2025.
Moroz pension was issued in 2012 under a special law for prosecutors. Like other “special pensions”, since January 2025 it has been restricted by the government: for payments exceeding 10 subsistence minimums (UAH 23 610), reducing coefficients were used. However, the court found such cutting illegal.
In her decision, Themis stressed that the acquired rights of citizens should be guaranteed by the state, and changes to the legislation cannot be retroactive when it comes to deterioration of conditions. By his resolution, the court obliged the Pension Fund to restore the payment of the pension without restrictions from January 1, 2025.
This case is not isolated. In the first quarter of 2025 alone, more than 800 court decisions concern the decree on reducing coefficients. Most of them are in favor of "special" pensioners, including prosecutors, judges, military and other pensions who receive pensions higher than UAH 23.6 thousand.
The new government pension policy has affected more than 17,000 people. After the restrictions, many of them began to go to the courts massively, and most have already won cases. The decision in favor of Lyudmila Moroz has become another confirmation that the reform initiated by the Cabinet of Ministers does not stand out in its current form.
