The Transcarpathian District Administrative Court issued an important verdict in which it recognized the mobilization of persons under the age of 25 as illegal. This decision was the result of consideration of a case in which a 23-year-old boy sued, claiming that his mobilization was carried out in violation of the law.
The court's decision states that during martial law, those who have reached the age of 25, or those who have served in the military department and are in the reserve, are subject to mobilization.
"This is a precedent. Imagine how many people will now go to the courts to get justice. How many cases will be considered by the courts", People's Deputy Goncharenko commented on this court decision.
We will remind that due to a legislative incident in Ukraine, people under the age of 25, who were recognized as having limited fitness during wartime, began to be mobilized.
After public outrage, the command of the Ground Forces of the Ukrainian Armed Forces sent a letter to the TCC, banning the mobilization of all persons under the age of 25.
A draft law banning mobilization under the age of 25 was submitted to the Council, but it has not yet been adopted.
