In the Chemerovets district court of Khmelnytsky region, a sentence of a border guard from Cherkasy region was issued, who in a state of alcohol intoxication was fatally injured by a knife of another serviceman. This is stated in the sentence in case No. 687/1370/24.
At the end of September 2024, a quarrel appeared between one of the temporary location of the border unit in the Khmelnytsky region. According to the investigation, both were intoxicated. During the conflict, a senior soldier from Cherkasy region hit his brother with a knife into the stomach. The victim died on the spot.
Both men were detained immediately. Crime - knife - seized law enforcement. Subsequently, the suspect was charged under two articles of the Criminal Code of Ukraine - Part 2 of Art. 121 (Severe bodily injuries that caused death) and Part 3 of Art. 406 (violation of the statutory rules of relations between servicemen, committed in the conditions of martial law).
The accused recognized the fact of injury, but stated that he acted within the limits of self -defense. According to him, the conflict arose after the dead twice hit him in the face, and the situation grew into a fight. However, witnesses confirmed only the presence of verbal conflict and did not see the threat of a soldier's life.
The defender requested the court to take into account these circumstances and re -qualify the case as exceeding the limits of the necessary defense, but the court disagreed with this version.
Sentence
Judge Valery Borsuk found the border guard guilty of committing both crimes. He was sentenced to 8 years in prison. In addition, the accused must pay the mother of the dead moral compensation of UAH 8.5 million.
The beginning of serving the sentence is counting from the moment of detention - September 2024.
