The capital's law enforcement officers are checking the facts of possible arbitrariness in the use of a land plot on Lyudmyla Protsenko Street in the Solomianskyi district of Kyiv, near Batyiv Mountain. According to the National Police, the lessee of the land — LLC "Rolan" — may not comply with the requirements for engineering protection of the territory from landslides and not provide an anti-slide regime. Separate questions are also raised by the prospect of residential development in the area, which, as investigators note, has restrictions due to the landslide hazard and location in the central historical area.
This is criminal proceedings No. 42025102090000062 dated April 22, 2025. Preliminary qualification - Art. 356 of the Criminal Code of Ukraine (self-government). On December 3, 2025, the Solomyanskyi District Court of Kyiv, at the request of the National Police, granted permission to inspect a plot of land with an area of 0.69 hectares (cadastral number 8000000000:72:184:0059). The inspection is to be carried out with the involvement of representatives of the KP "Specialized Department of Anti-Landslide Underground Works", as well as the relevant departments of the Kyiv City State Administration - Land Resources and Territorial Control. During the inspection, law enforcement officers plan to establish the boundaries and actual area of the territory, check the real intended use, the presence or absence of construction, as well as compliance with the requirements for anti-landfall measures.
Investigators indicate that LLC "Rolan" has been leasing this land since 2006. The purpose of the site is for the construction and maintenance of an apartment building with commercial, entertainment and market infrastructure. At the same time, the police report: on November 3, 2025, the KP "SUPPR" informed law enforcement officers that the tenant had not received any applications and project documentation regarding engineering surveys, strengthening slopes, retaining walls or other landslide prevention works. The company emphasizes that the site belongs to landslide-prone areas, and therefore approval and a set of protective measures should be a priority.
A separate block in the materials is the issue of urban planning restrictions. According to the investigation, there are currently no documents that would give the right to carry out preparatory or construction work and confirm the commissioning of any facilities in this territory. The Department of Urban Planning and Architecture of the Kyiv City State Administration informed law enforcement officers that the company did not receive urban planning conditions and restrictions: the applications that "Rolan" submitted in 2016 and 2023 were returned for revision.
The background to the conflict goes back years. Back in 2004, the Kyiv City Council agreed to lease the land for housing construction, and in 2010 the lease term was increased to 15 years. In 2020, the Kyiv City State Administration and the Kyiv City Council submitted a draft decision to terminate the lease agreement due to the fact that construction had not yet begun, as well as due to the debt for payment for the land. However, the project was never approved, and in 2021 the Kyiv City Council agreed to renew the lease for another 10 years, after which the prosecutor's office went to court with a demand to cancel the decision on the extension and terminate the agreement. As a result, law enforcement officers lost all three instances, and the Cassation Economic Court put the final point on January 31, 2023.
In the spring of 2025, the story gained new public resonance due to the position of the local community. Residents of a nearby building claimed that the potential construction could worsen the condition of their "panel" - they linked the risks to problems that, according to them, began after the construction of another residential complex nearby: basement flooding, cracks and subsidence, asphalt destruction, and drainage problems. Activists also drew attention to the announcement of the sale of the plot and the distributed visualizations of the project with two 22-story buildings and a multi-level parking lot. The company, in turn, assured that it was about the lower number of floors.
Against this background, additional questions arise regarding the tenant's financial discipline. In August 2025, the Kyiv Commercial Court upheld the Kyiv City Council's claim against Rolan LLC to collect rent arrears for the period from July 2023 to January 2025. The company repaid part of the debt during the trial, but the court ordered it to pay the balance.
The police are currently focusing on the safety aspect: given the landslide hazard and historical status of the territory, any development plans must be accompanied by strict restrictions and implementation of anti-landslide measures. For this reason, by court decision, law enforcement officers received permission to inspect the site, which should record its current condition, actual use and compliance with engineering protection requirements.
