The Supreme Anti-Corruption Court has fully acquitted two former employees of the State Bureau of Investigation, who were accused of provocation for bribery. As reported by "Court Reporter", the court found that the evidence in the case was collected as a result of provocation, and the elements of a crime were not revealed in the actions of the officials.
According to the investigation, in 2021, SBI officers allegedly organized the transfer of money to a man they knew so that he could contact the deputy head of the Lviv Regional Prosecutor's Office with a request to buy the seized land plot. The prosecutor refused the money and reported the incident.
The investigation revealed that the applicant had repeatedly cooperated with law enforcement agencies in exposing corruption crimes, receiving a reward for it, and in this case his actions were under the control of the SBU. Witnesses confirmed that the man had his own motivation and received instructions from other individuals.
The court found that the SBI officers did not commit any criminal acts and that the accusation was artificial, caused by a conflict between different law enforcement agencies. Also, the materials regarding the third defendant were separated into a separate proceeding due to his mobilization.
The decision of the Supreme Court of Justice emphasizes the importance of objectively assessing evidence and excluding provocations when investigating corruption cases.
