In Kyiv, the court sentenced an obstetrician-gynecologist who worked in a private clinic, sentencing him to 3 years in prison for the death of a newborn. The doctor was found guilty of improper performance of his duties, which led to the death of the baby due to an untimely caesarean section.
This was reported by the press service of the Kyiv City Prosecutor's Office. The accused was sentenced to prison, and the medical institution where he worked was obliged to pay compensation.
"Juvenile prosecutors of the Obolon district prosecutor's office of the city of Kyiv were able to prove the guilt of an obstetrician-gynecologist from one of the capital's private clinics. During the delivery, he made a medical error that led to the death of the newborn," the press service said.
The prosecutor's office recalled that the tragedy occurred in May 2020. During the delivery of a 32-year-old woman, the doctor made an incorrect assessment of the fetal CTG monitoring data and made an untimely decision to perform a cesarean section. As a result, the newborn baby suffered irreversible changes in the central nervous system and died after 55 days.
According to the conclusion of the complex forensic medical examination, a cause-and-effect relationship between the doctor's actions and the baby's death was confirmed. The doctor's actions were qualified as improper performance of his professional duties, which caused serious consequences for the minor.
As a result of consideration of the case, the court found the doctor guilty and sentenced him to three years of imprisonment with deprivation of the right to practice medicine for a period of one year. This is the maximum period stipulated by the relevant article.
"In addition, the court fully satisfied the claims of the injured party regarding the collection of compensation for moral damages in the amount of 1,170,000 hryvnias from the private clinic," the press service added.
