Ukraine has been in a full-scale conflict with Russia for the third year, but no declaration of war has been made. Why is this so, explained the head of the Ministry of Justice, Denys Malyusko, pointing to certain shortcomings in the wording of the Constitution relating to wartime. This, he said, creates certain conspiracy theories, especially regarding the non-declaration of a state of war.
Malyusko emphasized that even if war is declared in the third year of the conflict, it will not change the situation significantly or will not be able to explain to the society. According to the minister, from the point of view of international humanitarian law, the existence of a declaration of a state of war has no significant legal significance, since a military conflict already exists.
Malyusko emphasized that some lawyers express doubts about the expediency of declaring a state of war, as it may be considered a crime of aggression or may be unfounded, as Ukraine is defending itself. He also emphasized that recently Volodymyr Zelenskyy signed the law on the extension of martial law for 90 days, as well as the law on the extension of general mobilization in Ukraine.
