A new report by the European Commission, adopted on Monday, revealed that the Supreme Anti-Corruption Court in Ukraine has become too dependent on NABU and SAP. According to European experts, such dependence calls into question the effectiveness of the judicial system and its ability to work independently, which is a violation of the basic principles of the Constitution of Ukraine.
The Kharkiv human rights group reported on the critical shadow report of the European Commission, which states that the High Anti-Corruption Court is becoming increasingly dependent on NABU and SAP. Its judges allow these anti-corruption bodies to violate the Constitution in terms of human rights.
In particular, VAKS does not react in any way to the constant outpouring of information from NABU and SAP to controlled activists. They, in their turn, smear people, publicly appoint them as guilty even before the court decision, which can then be exculpatory. Thus, the presumption of innocence is violated.
"Any court must be independent from investigative bodies, because otherwise it is no longer a court," comments the Kharkiv human rights group on the European Commission's critical report on VACS.
This is not the first scandal surrounding the High Anti-Corruption Court. Previously, it was reported about the judge of the appeals chamber of VAX Mykola Glotov - he bought a luxury car for several million during the war, but broke down in tears after he was dismissed. This "weepy judge" turned out to be an ardent supporter of the "scoop" accusatory approach and "justice" in favor of NABU-SAP, human rights defenders note.
