Mobilization continues in Ukraine, but not all conscripts are subject to immediate conscription. The legislation provides for a number of exceptions that allow certain categories of persons to obtain a legitimate deferral from service. Here is what you need to know about the process of receiving a delay, who has the right and how to design it.
1. Delayed term: different categories, different approach
According to the Ukrainian legislation, the duration of delay on mobilization depends on the category of persons and circumstances. For some persons, such as students or persons with disabilities, a deferral may be short -term, while for others it may be longer. For example, persons with disabilities can count on a deferral for the entire period of disability, and students - at the time of one training semester (no more than 6 months).
For teachers, teachers and civil servants, a deferral can be for the whole school year or during their post. At the same time, for persons who are temporarily unsuitable for the medical commission, the delay does not exceed 12 months.
2. Health delay: illness and disability
Citizens who have medical contraindications for military service can also be deferred. It is provided on the basis of the conclusion of the Military Medical Commission (VLK), which states whether a person has temporary unsuitability for service due to health. The deferral can last from 6 to 12 months, with a mandatory re -examination.
Of particular importance are cases of disability. People with disabilities can be released from conscription for the entire period of their disability.
3. Relatives of the dead and missing persons: what are the rights?
Citizens who have lost their loved ones in hostilities are also entitled to deferral. This applies to men and women who are relatives of those who died or disappeared during an anti -terrorist operation or a full -scale war.
Also, the right to defer is granted to women, men or guardians who raise children whose parents are missing or killed during hostilities.
4. Delay for students and teachers
Students, graduate students, teachers and researchers are also entitled to deferral, but it depends on their professional activity. Students who study in full -time or dual form receive a deferral at the time of the semester (up to 6 months), and teachers - for the whole academic year.
It is also important that vacations or breaks in the school year are not a ground for losing the right to deferral. For teachers, this rule applies throughout the school year (from September 1 to August 31).
5. Delay for those who care for relatives
The law also provides for a deferral for those who care for relatives. It can be care for sick, minor children, people with disabilities, or those who need constant help due to serious illnesses.
This rule applies both for people who care for children and for those who care about minor children with disabilities or their parents who need help.
6. Reservations and specific deferrals for critically important businesses
Employees of strategically important enterprises can get a deferral through the booking process. Businesses that work in critical economics and safety industries can book their employees to perform the important tasks necessary for the state.
This also applies to medical workers, rescue services, as well as employees of higher authorities and local self -government.
7. How to design a delay?
The process of delay from mobilization is to submit relevant documents to the local military commissariat or through the online platform "Action". Citizens need to confirm the grounds for deferral, depending on their category.
It is important to remember that each delay case has its nuances, and for proper submission it is necessary to study the requirements carefully.
