The judicial and legal newspaper reports on a case when a soldier was sentenced to two years of detention in a disciplinary battalion for voluntarily leaving the unit. He was injured while evacuating a wounded man, but the commander forbade him to undergo a medical examination, and he decided to go on his own.
The decision was made by the Naval District Court of Mykolaiv. Andrii R., a resident of Odesa, was mobilized to the Armed Forces. In the rifle platoon, he received the position of unit commander, although he remained in the military rank of "soldier".
In the summer-autumn of 2022, the Andrii unit operated in the Kherson region, and the city of Mykolaiv was determined as the temporary location of the unit.
On September 13, 2022, he left the military unit. What he himself reported to the SBI a year later. He stated at the court that, while helping a wounded soldier, he injured both knees. I asked the commander to give him the opportunity to leave for treatment, but was refused.
Then Andriy voluntarily left his place of service and went to Odessa, where he had an MRI of the knee joints. She showed ruptured ligaments in her knees. The soldier sent a photocopy of the MRI report to the command, but they did not respond.
Later, Andrii himself repented and told the court that he wanted to return to the service. The court considered this as a mitigating circumstance and sent him to the disciplinary battalion for 2 years instead of imprisonment.
