In Ukraine, some categories of conscripts have the right to a deferment from mobilization, in particular, in the case when they perform the duties of caring for relatives with disabilities of the III group. Specialists of the law company INSEININ explained how to get such a deferment if, for example, the mother or father is a person with a disability.
Conditions for obtaining a deferral:
According to Ukrainian legislation, a man can get a deferment from mobilization if he cares for a mother or father with a disability of the III group. This is possible only if the care is officially registered as permanent third-party care, which is confirmed by relevant documents.
Documents required for submission to TCC and JV:
- A copy of the medical opinion of the Ministry of Health and Welfare or the Ministry of Labor and Welfare, confirming the disability of the father or mother.
- Documents confirming the provision of care for a relative, for example, an act or conclusion of social services on the appointment of a carer with compensation.
- Birth certificate.
What if the parents have other relatives?
Mobilization legislation does not prohibit obtaining a postponement of mobilization even if there are other relatives who can take care of a disabled person of the III group. The main thing is to provide documents that confirm the fact that the applicant is providing care. Thus, a conscript can get a deferment if he is the primary carer for his parents, even if they have other relatives.
This mechanism enables people who care for their loved ones with disabilities to get the necessary support and maintain their position during mobilization.
