The Yarmolynetskyi District Court of Khmelnytskyi Oblast has passed a verdict against a man who evaded mobilization despite receiving a summons. The court found him guilty under Article 336 of the Criminal Code of Ukraine and sentenced him to imprisonment for a term of up to 3 years.
According to the case materials, in July 2024, the man passed a military medical examination, which found him fit for service, after which he received a summons to the Central Military District. However, the man did not appear for the dispatch, which was the reason for the opening of criminal proceedings.
At the court hearing, the man partially admitted his guilt. He explained that at the time of serving the summons, he informed the lawyer of the CCC that he was raising his son alone, whose mother lives separately. He also stated that he had applied to the court to deprive the mother of his son of parental rights, but was not informed about the need for a court decision to obtain a postponement.
The man's mother confirmed that in July 2024, it was she who forbade him from going to the CCC, explaining this by the fact that he was raising his son alone. The 10-year-old child also confirmed that his mother does not live with him and has only seen her a few times. The man independently provides for his son financially and takes care of him.
In November 2024, the child's mother was deprived of parental rights, and in February 2025, the man received a deferment from mobilization. However, the court ruled that at the time of the service of the summons in July 2024, the man had no grounds for the deferment and found him guilty of violating the law.
