A serviceman and a civilian have been charged with aiding and abetting an official in obtaining an unlawful benefit. This is a criminal offense under Part 5 of Article 27 and Part 3 of Article 368 of the Criminal Code of Ukraine. This is reported by “Law and Business” with reference to the Specialized Prosecutor’s Office in the Field of Defense of the Central Region.
According to the investigation, the suspects used personal connections with officials of one of the district territorial recruitment centers in Cherkasy region. Acting out of selfish motives, they promised the conscript, for a monetary reward of 15 thousand dollars, to help with removal from the wanted list in the "Oberig" system, further registration of a deferment from military service and exclusion from military registration. To do this, the suspects assured that they would issue fictitious documents about the alleged need to care for a person with a disability.
According to the investigation materials, the perpetrators received the first part of the illegal benefit in the amount of $2,000 and handed over to the conscript fake certificates about the mother's disability and the need for her constant care. Having received the second part of the money — $7,000 — they were detained under Article 208 of the Criminal Procedure Code, and the funds were confiscated.
The prosecutor's office reported that both suspects were remanded in custody with the possibility of bail. Investigations are ongoing and other individuals who may have been involved in the scheme are being identified.
The sanction of the incriminated article provides for a sentence of five to ten years of imprisonment with confiscation of property and a ban on holding certain positions for three years.
