Banks may be required to disclose banking secrecy and personal data upon request by the police

A new provision requiring banks to disclose banking secrecy and personal data of customers upon request by law enforcement agencies was added to draft law No. 11043 before its second reading in the Verkhovna Rada.

This proposal has already caused a significant resonance in society and among experts in the field of law and finance. A vote on this bill is expected in the near future, reports Sudovo-Yurydychna Gazeta.

A request from the police may be received if a payment transaction contains signs of a criminal offense.

The bill was criticized by the Parliament's Main Legal Department, which believes it violates the Constitution.

"It is unclear how a payment service provider will determine whether a transaction contains elements of a criminal offense," the department says.

They added that the grounds for sending such a request to the police are not limited, although the amount of information involved is extremely broad.
