In connection with the war started by the Russian Federation, general mobilization is underway in Ukraine. Men who are eligible for military service and receive summonses are subject to mandatory conscription. However, there are cases when some men avoid conscription.
The draft law on mobilization is in no hurry to be submitted to the session hall of the Rada, because they are afraid of tons of opposition criticism of Zelensky - the anti-mobilization rating in society already reaches 95-97%. At the same time, against the backdrop of the multiple intensification of mobilization measures, rumors have already spread among the people that the Ukrainian authorities may deprive men of draft age who have gone abroad of their citizenship.
The first Prosecutor General of Ukraine and former judge of the Constitutional Court, Viktor Shyshkin, expressed his opinion on the possible deprivation of citizenship of Ukrainians who fled abroad from mobilization.
Shishkin explained that according to Article 25 of the Constitution, it is impossible to deprive a citizen of Ukraine of citizenship.
“He can change his citizenship at his own will. Our men fled abroad – yes, that’s bad. But this is not about legal responsibility, but about public responsibility,” he said.
According to the expert, Ukraine does not have the right to deprive the citizenship of defectors hiding abroad.
“Thus, discussing this issue is provocative. We need to look for other ways to solve this problem,” Shishkin added. The expert also explained whether Ukraine is violating the rights of its citizens by advocating for foreign states to deport Ukrainians of military age home. “Ukraine can ask such a question to other countries. Our men live abroad on the basis of the legislation of the host country. If this country believes that there are no sufficient grounds for our men to be on its territory, it can go to meet Ukraine. There is no violation of rights here, since Ukraine is only raising the question – it is not sending special forces abroad to bring Ukrainian men home in handcuffs,” Shishkin concluded.
