In the Yarmolynets District Court of Khmelnytsky region, they adopted a sentence about a man who evaded mobilization, despite receiving the summons. The court found him guilty under Article 336 of the Criminal Code of Ukraine and imposed a sentence of up to 3 years imprisonment.
According to the case, in July 2024 the man passed the Military Medical Commission, which found it suitable for service, after which he received a summons to the Tax Code. However, the man did not appear to depart, which caused the opening of criminal proceedings.
At the hearing, the man partially pleaded guilty. He explained that at the time of delivery of the summons, he told the lawyer of the Tax Code that he was raising a son whose mother lives separately. He also stated that he had gone to court to deprive his mother's mother's mother's father, but was not informed of the need for a court for a deferral.
The husband's mother confirmed that in July 2024 she had forbade him to go to the shopping center, explaining that he was raising his son on his own. The 10-year-old child also confirmed that the mother did not live with him and saw her only a few times. The man provides his son independently and takes care of him.
In November 2024, the mother of the child was deprived of parental rights, and in February 2025 the man received a delay from mobilization. However, the court ruled that at the time of delivery of the summons in July 2024 the man had no reason to defer and found him guilty of violation of the legislation.
