Is it possible to confiscate the real estate of conscripts who evade mobilization?

Article 210 of the Code of Ukraine on Administrative Offenses provides for administrative liability for failure to update the data of a conscript within 60 days. Violation of this article may result in a fine of 17,000 to 25,500 hryvnias.

In case of non-payment of the fine, enforcement proceedings may be initiated, during which the executor has the right to collect the debt from the debtor's accounts and movable property. Enforcement of immovable property occurs only in the absence of sufficient funds or movable property to satisfy the debt collector's requirements.

Lawyers said that seizing real estate of conscripts is unlikely, as the appraised value of the real estate usually exceeds the amount of the fine. The law also provides that in the case of ownership of property together with other persons, collection is carried out only on the debtor's share.

Thus, in the case when the immovable property is registered to other persons or in the case when the estimated value of the property exceeds the amount of the fine, the seizure for collection is not carried out.
