Lawyer Vladislav Deriy explained how to act if an employee of a strategically important enterprise is wanted on the line of TCC, but the company wants to submit his candidacy for booking. By law, such a person cannot be booked until he is removed from the search, but theoretically it can be done without a personal visit to the military enlistment office.
According to the current legislation, employees of enterprises of strategic importance for the economy and defense of Ukraine can be booked from mobilization. But one of the key conditions is the lack of wanted for violation of military accounting rules.
Vladislav Deriy, lawyer of the portal "Lawyers.ua", notes that if there is a suspicion that the employee is in a mistake, you can apply to the territorial center of staffing.
“ If you want to try to resolve this issue remotely, send the recommended letter to the shopping center where you are registered. In the address, ask to exclude a false entry from the register "Oberig" ", - advises Deriy.
He emphasizes that such a procedure has a chance of success only in the event of an obvious mistake. For example, if a person has not physically violated the accounting liabilities but the data in the register is incorrect.
The lawyer acknowledges that remote removal from the search is an exception rather than the rule:
«In the realities of today, it is extremely difficult to do this without a visit to the CCC. Often send a new summons instead of cancellation of the search or altogether refused request».
Therefore, the lawyer advises: if the question is critical, it is better to solve it in person or with the help of a lawyer.
It is important to understand that even if successful reservation, the employee remains on the military account and must follow the relevant rules. If the search was connected with a real violation of responsibilities - without personal explanation in the shopping center will not be able to do.
