Former head of the Khmelnytskyi City Medical and Social Expert Commission (MSEC) and traumatologist Lyubomyr Zavialets, convicted of corruption, decided to mobilize into the army.
Zavyalets was serving his sentence in the Khmelnytskyi pre-trial detention center, where he expressed a desire to perform military service under a contract. The institution's management, taking into account his desire, applied to the court with a request for parole. This became possible thanks to changes in the legislation adopted by the Verkhovna Rada in May 2024, which allowed convicts who voluntarily agree to serve to receive early release.
The court found that the former head of the MSEC meets the requirements for military service under a contract. He had more than three years left before reaching the age limit for military service, he is fit in terms of health, has passed a professional and psychological selection, and has a sufficient level of physical fitness.
The court granted the request of the SIZO management, and Zavialets was released early and transferred to the National Guard for further service in the military unit. If he had not been mobilized, he would have remained in prison for another year and four months.
In addition, the court imposed administrative supervision on the released convict for a year, which will be carried out by the commander of the military unit. The convict is obliged to adhere to restrictions, including a ban on staying outside the military unit's location without the commander's permission.
It is worth noting that in April 2023, the Khmelnytskyi City District Court found Zavyalets not guilty in the bribery case. However, in December 2023, the Khmelnytskyi Court of Appeal overturned the acquittal and sentenced him to two years in prison for receiving a bribe of $1,100 for assisting in granting disability.
After the appeal verdict, Zavialets tried to get a reprieve due to a serious illness, but the court refused this request.
