For four months now, the State Bureau of Investigation (SBI) has not implemented the court's decision in the case against Oleksandr Zyma, the chief lawyer of the National Bank of Ukraine (NBU). The situation caused concern for the injured party, Yulia Sosedka, who believes that delaying the investigation violates her constitutional rights.
I am very concerned that the State Bureau of Investigation continues to ignore court orders, violating my constitutional rights. We received a court order back in April, but the necessary procedural steps have not yet been completed. Such delay not only prevents the restoration of justice, but also calls into question the objectivity of the investigation. We will continue to fight for the truth and protect our legitimate interests
She added that the investigators still have not handed her the memorial of the victim, which would mean that the Neighbor received the appropriate status in the criminal proceedings.
"I want to say that we will not back down, because the National Bank official violated the law and the Constitution of Ukraine with his decision. He tried to deprive us of the opportunity to defend our rights and the rights of our bank in court," Yuliya Sosedka emphasized.
It is worth noting that Yuliya Sosyedka has not yet been recognized as a victim in criminal proceedings, but she was refused information. The law enforcement officers referred to the secrecy of the investigation.
Criminal proceedings against Oleksandr Zyma were opened under articles related to abuse of power and official position. The case concerns a letter from the National Bank of Ukraine to the Deposit Guarantee Fund of Individuals signed by Oleksandr Zyma, with which he recommended the Fund to withdraw the lawsuits filed by Concord Bank against the NBU. The document referred to the bank's four lawsuits against the NBU, in which "Concord" demanded the cancellation of fines totaling almost 63.5 million hryvnias. These lawsuits were filed even before the National Bank decided to liquidate "Concord" and introduced a temporary administration there.
Later, the Shevchenkiv District Court of Kyiv recognized Yulia Sosyedka, the co-founder of Concord Bank, as the victim in this criminal proceeding. After all, according to the co-owner of "Concord" Olena Sosedka, by his instructions, Zima deprived the shareholders of the bank of their constitutional right to a fair trial. At the moment, the investigation is ongoing.
Lawyers do not rule out that SBI investigators will continue to ignore Yulia Sosedka's rights as a victim, and therefore she will have to demand through the court to conduct investigative actions in criminal proceedings against Zima. At the same time, experts point out that law enforcement officers are in no hurry to open and investigate cases of economic crimes, because they do not want to engage in intellectual work.
