Developer Andriy Vavrish lost a legal dispute with the investor of the Rybalsky residential complex, who publicly called his actions fraudulent. The company in question is SAGA Development, which is implementing the project in the Podilskyi district of the capital.
Investor Nelly Werner spoke about the situation on her social networks. According to her, she invested in the project before the full-scale invasion began and managed to pay 75% of the cost of the apartment. After February 24, the developer temporarily canceled the mandatory monthly payments, but in December 2022, they were resumed.
“Manager Lyudmila started calling me actively back in the fall… Then there was no mention of a penalty. And already in April (2023) she sent me an offer to pay the balance for the apartment in one go, already at the adjusted exchange rate, the penalty was indicated in that payment – 1,500 UAH. Or terminate the contract,” describes Werner.
When the client refused to pay the remaining amount in the proposed manner, citing a difficult financial situation, the developer's representatives began to make additional demands. In particular, they were concerned with the retroactive charging of penalties — according to Werner, according to "incomprehensible formulas" — which led to a significant increase in the amount owed.
She also noted that the house she invested in was never completed within the stated timeframe.
After public criticism of the company and its manager, SAGA Development filed a lawsuit to protect its honor, dignity, and business reputation. However, the court found no grounds to uphold the lawsuit.
Thus, Nellie Werner won the case against Vavrisha's company.
