The Prosecutor General's Office has reported a former senior official of the State Fiscal Service to the Ministry of Finance of Ukraine on suspicion of abuse of office. His actions led to significant financial losses for the state budget.
The investigation found that, while holding a managerial position in the Central Office for Large Taxpayers of the State Fiscal Service, the official gave his subordinates an illegal instruction to prepare a letter to the Main Directorate of the State Treasury Service in Kyiv. The document referred to the failure to implement conclusions regarding VAT reimbursement to one of the private enterprises.
The official motivated his actions by the need to conduct additional inspections. However, after the conclusions were withdrawn, no inspection was carried out, despite the fact that the company had the legal right to a VAT refund.
As a result, the company did not receive a timely tax refund for its declarations for February–April 2015 and went to court. The court ordered the state to pay a penalty for the delay — almost 108 million hryvnias for the period from May 2015 to March 2021.
Thus, the state budget suffered losses equivalent to the specified amount. The actions of the former official are qualified under Part 2 of Article 364 of the Criminal Code of Ukraine as abuse of official position.
