Disciplinary case against prosecutor with disability closed

The Qualification and Disciplinary Commission of Prosecutors has decided to close the disciplinary proceedings against the prosecutor of the Law Enforcement Supervision Department of the National Police of Ukraine of the Kharkiv Regional Prosecutor's Office, Asriyan Larysa Aramivna. The decision was made on February 17 and formalized by a corresponding resolution.

The proceedings were opened on July 30 upon a complaint by the head of the prosecutor's office, A. A. Omarov. The basis for the inspection was the establishment of the prosecutor's second disability group by the decision of the Kharkiv Regional MSEC dated May 27, 2024, valid until May 1, 2026.

During the inspection, the Commission established that the second group disability was first determined back in 2008, long before Asriyan began working in the prosecutor's office. At that time, she worked as a lawyer in the private sector in the Donetsk region. Later, the disability group was repeatedly confirmed by decisions of the MSEC in 2009, 2012, 2014, 2020 and 2024.

The Commission also noted that the prosecutor did not make any requests for special workplace arrangements or changes in working conditions due to her health condition. She had been receiving a disability pension since 2008 on a general basis. In July 2024, payments were transferred to the basis of the Law "On the Prosecutor's Office", however, after another review of the disability group in May 2025, it was changed to the third group. Accordingly, the pension provision was returned to the general regime.

The decision to change the disability group was appealed in court. On February 10, 2026, the Kharkiv District Administrative Court upheld the claim and declared the relevant decision unlawful and subject to annulment.

Additionally, an internal investigation conducted in August 2025, as well as the conclusion of the KDKP member Vitaliy Mavrodi dated February 2, 2026, did not establish the nature of a disciplinary offense in the actions of the prosecutor.

Based on Part 5 of Article 48 of the Law of Ukraine “On the Prosecutor's Office”, the disciplinary proceedings were closed. The decision was signed by the Chairman of the Commission, Maksym Radzivon, and members of the Commission for the Prevention of Corruption in Ukraine.

The prosecutor has the right to appeal this decision in accordance with the procedure established by law within one month from the date of receipt of a copy of the document.
