On January 23, 2025, the Chamber of Appeal of the Supreme Anti -Corruption Court (Wax) made the final decision in case No. 991/9618/24, rejecting the appeal of the former President "Motor Sich" Vyacheslav Boguslaev. According to the Ministry of Justice, the court confirmed the decision of the first instance of December 2, 2024 and left the verdict on the confiscation of the assets of Boguslaev.
What did the court decide?
The lawsuit of the Ministry of Justice on the application of sanctions against Vyacheslav Boguslaev was fully satisfied. The state's income was confiscated:
- buildings and structures of the economic complex in the city of Primorsk, Zaporizhzhya region;
- 100% of the share in the authorized capital of LLC "Inna".
According to the legislation, the resolution came into force immediately after proclamation and is not subject to appeal in cassation.
Background of the case
This is not the first time that Boguslaev's assets fall under confiscation. On June 25, 2024, the BCS Court of Appeal left the decision of the court of first instance in case No. 991/558/24, where sanctions were also applied against Boguslaev.
The actions of the former head of Sich Motor have previously raised numerous questions about possible cooperation with foreign structures that pose a threat to Ukraine's national security. In particular, Motor Sich company was at the epicenter of scandals through the transfer of technologies and strategic assets, which caused the attention of law enforcement agencies.
The decision of the Appeal Chamber of Wax puts a point in this case, finally consolidating the confiscation of assets by the state. At the same time, this can be a precedent in the fight against corruption and the wrongful use of Ukraine's strategic assets.
