The Lviv Department of the State Tax Service conducted another scandalous tender for servicing their facilities, which resulted in UAH 8.9 million reached the company "Service-PMM". The competitive conditions were prescribed so detailed that they actually restricted the participation of other participants. As a result, the sole contender was a company that previously received orders from taxpayers without trading.
In order to participate in the tender, the contractors had to confirm that they had already served at least 24 objects at the same time, with a total area of more than 39 thousand square meters. m. It was also required that the previous contract has a complete list of services specified in the technical task of the customer. In addition, this list included specific models of diesel generators and other specific details.
Such conditions immediately raised suspicions among the potential participants of the tender. Anonymous companies stated that the requirements were registered so as to narrow the competitors. Only one company won open bidding-Service-PMM LLC, which received a contract for UAH 8.9 million.
It is interesting that earlier a similar contract without a tender was concluded with the same firm because of the "urgent need". In 2023, another company - Griffin Service LLC - successfully challenged the rejection of its application in the Antimonopoly Committee of Ukraine (AMCU), but after that the tax authorities simply canceled the tender, explaining that "the need for services disappeared after the end of the year." Now the requirements have become even tougher, which practically made it impossible to participate in other companies.
What is known about the winner?
Service-PMM LLC was established in February 2024. Its owner and leader is Ostap Khomyak-Dedyshyn from Lviv. He also manages another company-PMM-Service LLC, registered in Kiev. The owner of this company is Irina Melnyk from Chernivtsi, who previously received similar contracts from Lviv tax authorities in 2022-2024.
The new "service-PMM" has already won the state contracts by UAH 12.6 million, and the old PMM-Service has received contracts for UAH 85.04 million since 2021. Both companies actually specialize in working with taxpayers, which raises additional questions about the honesty of procurement procedures.
This situation once again demonstrates how the "ideal conditions" are created in government procurement to win the necessary contractors, which brings to competition.
