NABU and SAPO have reported suspicions to the former deputy head of the department of the Prosecutor General's Office of Ukraine. According to the investigation, his actions led to multimillion-dollar losses for the state budget.
According to law enforcement, the former prosecutor assisted one of the heads of the State Fiscal Service in abusing his official position during the consideration of a tax dispute. This is a situation when the company appealed a tax notice-decision to the State Fiscal Service.
The First Deputy Head of the State Fiscal Service, who was supposed to make a final decision on the complaint, deliberately failed to do so within the time limit established by law. Such actions, as investigators note, were carried out in the interests of the enterprise and with the assistance of an official from the prosecutor's office.
The prosecutor played a key role in the scheme. On the last day of the deadline, he seized all the tax audit materials, creating an artificial situation in which signing the decision became allegedly impossible. The SFS official officially stated that he could not make a decision due to the lack of documents.
As a result, the company's complaint was automatically deemed satisfied. The state lost the opportunity to collect tax liabilities and penalties in the amount of over 641 million hryvnias.
The NABU and SAPO note that the actions of the suspects have been qualified as abuse of office, which led to serious consequences. The investigation is ongoing, and the full circle of persons involved in the implementation of the scheme is being established.
