How to get “armor” from mobilization: step-by-step instructions for entrepreneurs

Who can apply for “reservation”?
Ukrainian enterprises and individual entrepreneurs can reserve their employees from mobilization if their activities are critically important for the state. Lawyer Dmytro Franchuk explained that this became possible thanks to a new Cabinet resolution of November 22.

Critically important enterprises are those operating in the following areas:

  • energy,
  • transport,
  • medicine,
  • defense industry.

Sole proprietors engaged in, for example, car repair for the military can also obtain this status.

Basic criteria for booking

  1. Critical Enterprise Status. To obtain this status, you must apply to the relevant ministry responsible for a specific area of ​​activity. The application must provide evidence of defense contracts, partnerships, and significance to the state.
  2. Salary. One of the key requirements is the level of employees' salary - at least 20 thousand hryvnias.
  3. Documentary confirmation. All data on the activities of the individual entrepreneur or enterprise must be described in detail in the submitted documents.

Employee reservation procedure
To make a “reservation”, an individual entrepreneur or enterprise must:

  • submit lists of employees to the Ministry of Defense,
  • use the “Diya” portal to transfer documents,
  • wait for approval from the General Staff of the Armed Forces of Ukraine.

The booking decision is confirmed by a certificate that is valid for six months with the possibility of extension.

Features for mobilized individual entrepreneurs
Individual entrepreneurs who have already been mobilized cannot continue to run their business independently. They must transfer the management of the business to another person by proxy so that the enterprise can continue to operate.

Dismissal of employees with “reservations”
If an employee who was reserved is dismissed, this automatically deprives him of his “reservations”. The enterprise is obliged to notify the Ministry of Defense or the CCC of this, after which the reservation position becomes vacant.

Tips for entrepreneurs

  1. Prepare the necessary documents confirming your activities in a timely manner.
  2. Make sure that the salary level meets the requirements of the Cabinet of Ministers.
  3. Establish cooperation with relevant ministries to confirm the significance of the business.

Obtaining “armor” is a difficult but real process for those who make a significant contribution to the work of critical sectors of Ukraine’s economy and defense.
