How to properly appeal a decision of the MSEC: step-by-step instructions

The Center for the Assessment of the Functional State of a Person is engaged in verifying the validity of the decisions of expert teams and considering complaints about these decisions. It aims to ensure fairness and transparency of the assessment process, which is important for people who need medical expertise from different regions of Ukraine.

How to file a complaint?

A complaint can be filed both electronically and in paper form. To file an electronic complaint, you must contact the treating physician who referred the person for evaluation. The physician will complete the complaint electronically and send it to the Center via the electronic system. A paper complaint can be sent by mail.

Deadlines and requirements for a complaint

The complaint must be filed within 40 calendar days of receiving the extract from the decision being appealed. It is important that the complaint contains:

  • Complainant's full name,
  • Address of residence or stay,
  • Contact details (phone, email),
  • Requirements and justification,
  • Date of filing the complaint.

Missing the deadline for filing a complaint

If the deadline for filing a complaint is missed for good reasons (for example, business trip or temporary incapacity for work), a request for extension of the deadline can be submitted. This request is submitted to the Assessment Center with confirmation of good reasons (copies of documents). The Center considers the request within five working days.

Review of the complaint

The complaint can be reviewed in various ways: in person, in absentia, or via telemedicine. The expert team evaluates the documents, listens to the complainant's explanations, and, if necessary, conducts a re-evaluation based on medical examinations.

If the complainant refuses the medical examination or fails to appear for it without good reason, the expert team may overturn the contested decision.

Possible Assessment Center solutions

After reviewing the complaint, the Assessment Center may make one of the following decisions:

  1. Confirm the appealed decision.
  2. Cancel the contested decision.
  3. Make a new decision based on re-evaluation.

Each decision is signed by all members of the expert team.
