The Department of State Architectural and Construction Control (DASC) under the Kyiv City State Administration is trying to challenge the legality of the construction of the Desnianske cottage town in Troyeschyna through the court. Officials are demanding the cancellation of the permit issued back in 2010 and 47 declarations of readiness of the buildings for operation.
The essence of the conflict
The construction was carried out by the company “Vertical”, associated with the well-known businessman and former Kyiv City Council member Anatoly Karpenko. The lease agreement for the 61.7-hectare land plot expired in 2013, but work on the territory continued. The Kyiv City State Administration believes that from now on, all objects should be classified as unauthorized construction.
Despite this, the developer continued to file declarations, and some of the plots were divided and transferred to the ownership of individuals for residential development.
In February 2025, the Kyiv District Administrative Court refused to satisfy the Kyiv City State Administration's claim. In June, the Sixth Administrative Court of Appeal upheld this decision. The judges noted that after the registration of ownership of the houses, there was no point in canceling the declarations - they had lost their validity. At the same time, the officials were advised to file another claim - for the demolition of illegally constructed objects, but this requires an official opinion from the competent authority.
Currently, the State Administrative Court of Kyiv has filed a cassation appeal, which was accepted for consideration by the Cassation Administrative Court on July 31, 2025.
Prehistory
Back in 2002, the Kyiv City Council transferred over 60 hectares of land to “Vertikala” for cottage development. Initially, it was planned to build 335 houses, but later the project was increased to 339. Part of the land was seized in 2004, but later there was an actual “replacement” of the plots, which caused new disputes. In 2017, the Kyiv City Council divided the land into over 240 separate plots, some of which were transferred to individuals.
The founder of the company "Vertikal" is the charitable foundation "Dzvin Nadiye", which is controlled by Anatoliy Karpenko, a former deputy of the Kyiv City Council from "UDAR" and a businessman. His name has been repeatedly linked to conflict-related developments in the capital.
The Court of Cassation must decide whether there are grounds to overturn the decisions of the previous instances. However, even if successful, the Kyiv City State Administration will have to prove the fact of unauthorized construction and demand the demolition of the cottages in court.
