In Transcarpathia, the Mizhhirskyi District Court has sentenced a man to 3 years and 6 months in prison for evading mobilization. As stated in the verdict, in December 2023, the man received a summons, but wrote a statement refusing to serve in the Armed Forces of Ukraine, explaining his decision by fear of war and the fact that his brother was already serving.
During the trial, the defendant admitted his guilt, but drew attention to the personal circumstances that contributed to his decision. However, the court, taking into account the man's previous outstanding conviction for distributing pornography, imposed a harsher sentence.
According to Article 336 of the Criminal Code of Ukraine, evasion of mobilization during wartime is punishable by imprisonment. This decision emphasizes the seriousness of the approach to mobilization issues during wartime and serves as a warning to other potential draft evaders.
This case is yet another example of how the justice system responds to draft evasion during martial law. It is also worth noting that the Cabinet of Ministers of Ukraine recently adopted a resolution on the procedure for deferring military service, which has caused concern among the educational community.
