Two border guards fled abroad in Transcarpathia

The Rakhiv District Court of the Transcarpathian region considered the case of a border guard who was accused of neglecting military service, which led to the escape of two of his colleagues to a neighboring country.

As stated in the case materials, on September 27, 2024, a border patrol consisting of two servicemen - residents of the Sumy region - took up service on the section of the state border of Ukraine.

Dmytro D., who was on duty, was to maintain contact with the said servicemen. Every 30 minutes, Dmytro D. was to conduct communication sessions with the border guards who were on the border section.

However, according to the case materials, Dmytro D. did not conduct communication sessions, but he made the corresponding formal entries about the communication sessions in the workbook of the border guard unit.

Suddenly, on September 27, the border patrol did not return to the unit's location - most likely, at around 00:50, both border guards fled to the territory of a neighboring country.

According to the command, Dmytro D. violated the requirements of the "Instructions on the Service of Border Troops of the State Border Service", the Charter of the Internal Service of the Armed Forces, and the order for the border detachment "On the Organization of Operational Duty Service in 2024.".

Dmytro D. pleaded not guilty. In his defense, he explained that on September 26-27, when he was on duty, he had a heavy workload, which is why he was unable to contact the border guard in time. In any case, he could not physically prevent his colleagues from escaping.

Dmytro D. added that at the time when, according to the command, he was supposed to have a communication session with the border detachment, he should have had time to rest, but at 00:08 on September 27, he still had a communication session with the detachment.

Dmytro D. also drew attention to the fact that, as it turned out during the official investigation of the incident, both border guards were seconded to the border service department and had known each other for a long time, and they had previously tried to illegally cross the state border twice.

Having examined the case materials, the court established that Dmytro D. did indeed violate departmental instructions and orders, and therefore his guilt in negligent attitude towards military service is proven.

On December 3, the Rakhiv District Court of the Transcarpathian region held Dmytro D. liable in the form of a fine of 17 thousand hryvnias.
