On August 4, 2025, the Commercial Court of Kyiv Region satisfied the claim of the Innovation Development Fund against VNEBI-TECH LLC and decided to recover from the company UAH 555.7 thousand in debt under the BRAVE1 grant program.
Case No. 911/1255/25 was considered in a simplified claim proceeding without summoning the parties. The plaintiff demanded the return of UAH 502 thousand of the principal debt, UAH 53 thousand of inflation losses, and 3% per annum.
As the court established, on November 9, 2023, an agreement No. 79-BRV/11/2023 was concluded between the Innovation Development Fund and LLC "VNEBI-TECH" on the provision of a grant for participation in the BRAVE1 program, which is aimed at the development of defense technologies. The total amount of funding was UAH 901 thousand. The funds were transferred in one tranche to a separate account of the enterprise.
According to the terms of the agreement, the company undertook to use the funds exclusively in accordance with the approved budget, to submit financial statements and supporting documents through the fund's web portal. The Monitoring Commission had the right to audit expenses and, in case of violations, to demand a refund of funds.
After analyzing the reporting, the commission found inadmissible expenses in the amount of UAH 502 thousand - they were not provided for in the estimate and did not have proper documentary confirmation. By the decision, formalized by protocol No. BRV-369 dated August 28, 2024, the report was refused approval and the funds were required to be returned within two banking days.
In its response dated September 25, 2024, the company explained the changes in the nomenclature of components by the needs of the front and the difficult financial situation, but did not return the funds. By the repeated decision of the commission (minutes No. BRV-518 dated November 12, 2024), the requirement was left unchanged.
The court found that the company violated the terms of the contract, did not eliminate the identified shortcomings and did not provide evidence of the legitimacy of the costs. The court found the calculation of inflation losses and 3% per annum to be justified. The company returned the remaining grant amount of UAH 1,514.50 on November 26, 2024.
At the same time, the case materials indicate that representatives of VNEBI-TECH LLC did not participate in the trial.
The company was registered in August 2023, shortly before receiving the grant funds. The head of the company is Gennady Ivanovich Pryshchepchuk. The founders include Oleg Mykolayovych Zasukha, Oleksiy Igorovych Kharchenko, Iryna Oleksandrivna Nekrasova, and Oleg Serhiyovych Kravchenko.
