The Government of Ukraine submitted to the Verkhovna Rada a draft law aimed at simplifying the procedures for the international search of suspects and ensuring access to their belongings and documents abroad. This was reported in a press release of the government press center.
1. In particular, it is proposed to supplement the Criminal Procedure Code with a new provision that the investigating judge can issue a temporary ruling on access to things and documents of suspects who are in the territory of a foreign state.
Information about who exactly will get such access to the suspect's belongings and documents will be removed (hidden) in the decision of the investigating judge.
2. The search for suspects is simplified if they do not appear when summoned by the investigator or prosecutor, and there are grounds to believe that they are abroad or in temporarily occupied territories.
In this case, the investigator or prosecutor declares such a suspect on international wanted list.
3 Novation regarding confiscation of assets. In the event that the guilty verdict provides for the special confiscation or confiscation of property or other assets located abroad, which were seized, the court/reporting judge within 15 days draws up a petition for the recognition and execution of the guilty verdict of the court of Ukraine in a foreign state and sends it to the Ministry of Justice.
4 Information on international cooperation in the criminal process will be limited. Access to information on the receipt of a foreign request for international cooperation and its content, on the measures taken for its implementation, as well as to the materials attached to the request, or to the documents and information obtained as a result of its implementation, is granted only to persons who carry out authority related to the processing, consideration and fulfillment of the request, or involved in the fulfillment of the request.
5. The possibility of applying the arrest for the actual transfer to a foreign state upon extradition request of the person for whom the extradition arrest period has expired is introduced. We are talking about foreign citizens who are in Ukraine, for whom an extradition request has been received.
