The former police investigator received five years for the "loss" of evidence worth 1 million hryvnias

The former investigator of the Holosiiv police department, and now the deputy head of security at "Defendo" LLC Ihor Musiyuk, was found guilty of the loss of seized evidence in the amount of more than 1 million hryvnias. This is stated in the verdict of the local court of Kyiv under Part 2 of Art. 367 of the Criminal Code of Ukraine.

The incident with the seizure of evidence

In 2017, the police began an investigation into the possible abuse of official positions by officials of the State Aviation Service. During a search in November 2018, investigator Musiyuk seized a laptop and a significant amount of cash: 26.6 thousand US dollars, 16 thousand euros, 175 British pounds, 660 Russian rubles, 30 Swiss francs, 40 Polish zlotys and 2 thousand hryvnias , which belonged to the director of a private company.

The judge seized only the laptop, but refused to seize the funds. On the same day after the court session, Musiyuk invited company representatives to his office, showed them the money, but refused to return it until receiving the full text of the court's decision.

After receiving the full text of the decision, the money was not returned because the investigator lost it along with the laptop. It turned out that the funds were not deposited in the bank, and the laptop was not transferred to a special room. All seized items were kept in Musiyuk's office, to which an unknown number of people had access. The total amount of damage was estimated at more than 1 million hryvnias.

Trial and verdict

During the court session, Musiyuk pleaded not guilty and explained that he was ordered not to give the money right away, as they would appeal against the refusal of arrest. He allegedly first put the money in a police safe and then kept it in a clothes closet in his office. When the money disappeared, the investigator offered the owner to return it in parts, but he refused.

The investigator disappeared from work without explanation, and later it became known that he went to Turkey and was declared wanted. After an inventory of the workplace, it turned out that the money seized during the search had disappeared.

The former investigator was sentenced to five years in prison. Until the verdict becomes legally binding, he was assigned a preventive measure in the form of house arrest at night.

Damages and non-pecuniary damage

The victim previously filed a lawsuit against the regional police department for recovery of moral and material damages. In 2023, the appeals court decided to recover more than a million hryvnias from the police. However, until now, the state has not compensated the entrepreneur.

The court also decided to recover moral damages from the accused. Since the entrepreneur's family planned to buy a country house to improve living conditions, but due to official negligence of the investigator it was not possible to do so, the court determined the amount of moral compensation in 100 thousand hryvnias.
