The Kyiv City Prosecutor's Office won a court victory in the first round of the dispute over the cancellation of the registration of ownership of a non-residential building with an area of 517.3 sq. m., which was allegedly located on a plot at 12 Spaska St. (Podilskyi District). On September 2, 2025, the Kyiv City Commercial Court satisfied the prosecutor's office's claim (case No. 910/5325/25): the state registration of ownership of LLC "Blacksquad" was canceled, the purchase and sale agreement between "Blacksquad" and LLC "Law Company "Noosphere Plus"" was declared invalid, and the registration of ownership of the latter was also canceled.
According to the prosecutor's office, the registration actions were based on documents that did not actually exist: the act of the acceptance commission on commissioning and the order of the district administration on assigning the address, as well as on the technical passport issued by an individual. During the inspection of the site, law enforcement officers established the presence of two real buildings — administrative and economic (with an area of about 248.8 sq. m) — but did not find any structure with an area of 517.3 sq. m. The prosecutor's office qualifies the situation as a classic "toilet scheme", when an allegedly paper structure is used for the subsequent allocation of a land plot without holding an auction.
The plot with cadastral number 8000000000:85:362:0004 (0.22 ha) is in permanent use of the Kyiv Scientific and Methodological Center for the Protection, Restoration and Use of Monuments (KNMC) on the basis of an act dated February 27, 2002. On the same land is located the historical Apshteyn estate - an architectural monument of the late 19th - early 20th centuries, which houses the Department of Cultural Heritage Protection of the Kyiv City State Administration and the KNMC subordinate to it. Because of this, the case has attracted increased attention from the media and the public.
The court decision states that the state registration of the ownership of LLC "Center for Investment and Construction Research" (later LLC "Blacksquad") on March 16, 2016 took place on the basis of documents that were not actually issued by the relevant authorities, and the order of the Regional State Administration, indicated as the basis, referred to a different address. The Kyiv City Bureau of Technical Inventory also informed the prosecutor's office that no one had registered a non-residential building at this address.
The prosecutor's office does not directly name who is behind the construction, but in publicly available analytical reports (YouControl), "Law Company "Noosphere Plus"" appears in the orbit of business structures associated with former Kyiv City Council member Pavlo Teslenko. The materials also mention that previously a number of real estate objects in the capital fell into the hands of companies close to his entourage. In the court decision and accompanying reports of the prosecutor's office, these facts are presented as the basis for increased control over the further fate of this site.
At the time of publication on the website "Judiciary of Ukraine", there are no appeals from the relevant companies, but the prosecutor's office and experts do not rule out that "Blacksquad" and "Noosphere Plus" may appeal the decision.
This case is part of a broader wave of attention to mechanisms for the allocation of urban land without bidding, known in the media and among activists as “toilet schemes.” In Kyiv, law enforcement agencies are also dealing with such issues: in February 2025, the NABU and SAPO reported suspicions to the defendants of a large operation against corruption schemes with land (Operation Clean City; criminal proceedings No. 52023000000000154), and the prosecutor's office and city authorities declare their intentions to return the lost plots to the community.
The Kyiv Prosecutor's Office says that such court decisions are an important step to prevent abuse and protect municipal property. The city, in turn, must resolve the issue of protecting the Apstein monument and avoid situations where neighboring "paper" structures create a risk of illegal land acquisition.
