The Lviv District Administrative Court has opened proceedings on a lawsuit filed by the prosecutor's office, which demands the cancellation of the Lviv City Council's resolution on the allocation of land for the construction of the former kindergarten No. 107 at 13 Panas Myrny Street.
This is a plot of almost 0.7 hectares, where a kindergarten operated until 1992. After the institution was liquidated, the premises were transferred to the Interschool Educational and Production Complex of the Galician District, but already in 1994 the head of the Interschool Educational and Production Complex sold the building to a private individual. Subsequently, it was resold several times, and since 2007 the abandoned building has belonged to Rosanbud LLC.
Despite repeated attempts by the city council to challenge the privatization of the kindergarten, the courts sided with the owners. In May 2024, deputies granted Rosanbud permission to develop a land use plan for the construction of residential buildings. The Frankivsk District Prosecutor's Office of Lviv believes that this decision is illegal, because according to the city's general plan, the site is designated for educational institutions, and housing construction is prohibited there.
In addition, prosecutors emphasize that the company received permission without a competition, although its real estate on the site occupies an area eight times smaller than the entire allocated land. In such cases, the law requires land auctions.
Rosanbud was registered in 2008, among its founders was the Postal and Logistics Group “Mist Group”. Until May 2024, the owner of the company, as well as the postal operator Meest, was Rostyslav Kisil. Now 100% of the shares belong to his wife Natalia Kisil. In 2008–2009, the director of Rosanbud was the current Prime Minister Denys Shmyhal.
Volodymyr Tymchyshyn, the chairman of the supervisory board of Rosanbud, said that they plan to build a 4-story club-type residential complex on the site of the abandoned building. This is opposed by residents of the area, who demand that the kindergarten be restored.
In addition to the land conflict in the control zone of the customs post "Lviv-poshtovy", where the MMPO JV "Rosan" operates, the SBU has repeatedly recorded shipments from abroad of items similar to parts of firearms and ammunition. In 2024–2025 alone, several criminal proceedings under Art. 201 of the Criminal Code of Ukraine (smuggling) were documented, in particular:

On April 28, 2025, 13 items resembling weapon parts were seized (Walter 9mm, P80 slide housing, magazines, recoil springs).

On April 22, 2025, 1.45 kg of smokeless gunpowder and 500 cartridge elements hidden in tea boxes were discovered.

On November 20, 2024, stock, collimator sights, weapon barrel, and other components were seized.

On November 1, 2024, plastic buttstocks with hidden bolt frames for AR-15 were found.
The cases are being investigated by the SBU.
The legal process to overturn the LMR's decision is ongoing, and the future of the former kindergarten site depends on the court's decision.
