Lawyers and judges leaked information about investigative actions to those involved in NABU cases

The case of the law firm "Guarantee of Your Rights", headed by Dmytro Borzykh, is far from the only case of information leakage from the Unified State Register of Court Decisions. As NABU Director Semen Kryvonos stated in an interview with ZN.UA, this is a massive and systemic compromise of access to the Unified State Register of Court Decisions, in particular by judges and officials.

According to him, the situation is much more serious than previously thought and goes far beyond the jurisdiction of anti-corruption agencies. NABU detectives have recorded dozens of cases where hundreds of thousands of requests to the registry were made from a single account, and from thousands of different IP addresses.

"For example, one of the judges made 1 million 174 thousand requests. And this is not an isolated case. We found users with 1.084 million and 1.072 million requests. And what's most frightening is that the login occurred from more than 5 thousand different IP addresses," Kryvonos emphasizes.

Until recently, access to the registry was protected only by a login and password, which made the system vulnerable to leaks. Currently, the so-called "hard key" is used - a physical medium, which significantly complicates unauthorized access. However, the consequences of the previous "hole" will remain relevant for a long time.

"We found that leaks occurred not only in NABU cases. The problem is systemic, it covers the entire law enforcement system," the bureau director noted.

The investigators were particularly interested in lawyers from the company "Guarantee of Your Rights", who created a fully automated bot to extract data from the registry - this allowed them to know in advance about upcoming investigative actions, searches, and arrest warrants. Their main interest is in cases investigated by the NABU, in particular, those involving top officials.

However, as Kryvonos noted, there are other law firms that have been trading access to the registry for years, exploiting weaknesses in the system.

NABU is currently conducting a large-scale comparison of IP addresses, accounts, and case plots, after which the materials will be transferred to the cyber police. The Bureau also proposes legislative changes:

  • Temporary classification of some court decisions, in particular at the stage of pre-trial investigation;

  • The possibility for a prosecutor or investigator to prohibit the publication of a specific decision;

  • Improving the registry access system.

"Investigators who come to search immediately see when the suspects have already been warned. We have recorded this more than once. If we do not close this "hole", it will continue to kill justice in investigations," summarizes Semen Kryvonos.
