The Appellate Chamber of the High Anti-Corruption Court (HACC) has upheld the decision of the court of first instance, which found the assets of the family of an employee of the Kharkiv District Police Department to be unfounded. This concerns a Lexus LX 450D SUV and part of the cost of an apartment in Kharkiv - a total of almost 8 million hryvnias.
As reported by the publication "Law and Business" with reference to the National Agency for the Prevention of Corruption (NACP), the basis for adopting such a decision was the results of the joint work of the NACP, the State Bureau of Investigation, NABU, and the SAPO.
According to the case materials, the law enforcement officer and his wife own a 2018 Lexus car worth UAH 3.8 million, as well as an apartment in Kharkiv with a market price of UAH 5.8 million. However, an analysis of the couple's official income and savings shows that their funds would not be enough to purchase either a premium car or real estate.
Therefore, the court recognized part of the apartment's value — 4 million hryvnias — and the full value of the car as unfounded assets that will be collected as state revenue in accordance with Article 290 of the Civil Code of Ukraine. The decision entered into force immediately after its announcement.
This is another example of how, thanks to the lifestyle monitoring mechanism and effective interdepartmental cooperation, it is possible to identify and seize illegally acquired property of officials.
