According to the announcement of lawyer Yaroslav Kuts, a new law on mobilization will enter into force on May 18, which provides for a number of changes in the activities of law enforcement agencies. The expert illustrated whether the police will have the right to detain persons and deliver them to the TCC and SP.
"According to the new legislation, which comes into force on May 18, if a person who is wanted for evasion of military duty is listed in the registers and has not appeared after receiving a summons, the police will have the right to detain him and deliver him to TCC", explained the lawyer.
Yaroslav Kuts also noted that currently this practice takes place with a different approach. According to him, any patrol officer working on the streets and interacting with citizens acts within the framework of the legislation on the National Police.
"Policemen have the right to check a person in their bases, in particular, in the Armor base, where in recent years information is kept about persons who evade military duty at the request of military commissars and other authorized persons. Although it is currently controversial from a legal point of view, an appeal against this decision is unlikely," the lawyer concluded.
