On January 8, the Poltava Court of Appeal sentenced Oleksiy K., who was accused of making and distributing a porn video with the participation of his ex-girlfriend. The court considered the appeal, as a result of which the sentence was changed, but the accused managed to avoid punishment due to the expiration of the statute of limitations.
It is known that Oleksiy K. filmed sexual acts with his girlfriend between January and June 2019, after which, when the couple broke up, he began sending these videos to the ex's friends and acquaintances via Facebook Messenger. According to the verdict of the Kyiv District Court, the boy was found guilty of violation of private life and distribution of pornography (Part 1 of Article 182 and Part 2 of Article 301 of the Criminal Code of Ukraine).
However, Oleksiy K. denied his guilt in court, claiming that he did not send the video to anyone. However, based on the collected evidence, the testimony of the victim and witnesses, the court found him guilty.
The court sentenced him to one year in prison, but since the statute of limitations for prosecution had expired, the sentence was reduced: the accused was released from serving the sentence, and the criminal proceedings were closed.
In addition, the appellate court decided to confiscate into state property physical evidence — a mobile phone, a tablet and a flash drive seized from the accused during the investigation.
This sentence becomes legally binding from the moment it is announced and can be appealed in the cassation procedure within three months.
