Two lawyers from the law firm "Guarantee of Your Rights" - Maksym Komarnytskyi and Denys Mykulin - have been notified of suspicion in the case of preparing a bribe to a judge for an acquittal in the proceedings on the theft of sand from JSC "Ukrzaliznytsia". According to the investigation, the defendants, through their connections in the expert institution, intended to obtain the "necessary" conclusion and, on its basis, determine the amount of illegal gain for the court.
The case is being handled by the NABU and the SAPO. The investigation into the “Borzykh group” has been ongoing since 2023 and covers interference with the Unified State Register of Court Decisions and influence on judges and their staff. Previously, Komarnytsky was indicted for unauthorized access to the closed part of the register: the investigation says there were over 39 thousand search queries and viewing of 7.5 thousand documents. Under suspicion in the “register” episode are Dmytro Borzykh, as well as lawyers Andriy Filiuk and Maksym Komarnytskyi; detectives are focusing on six out of twenty company employees.
The legal qualification covers receiving illegal benefits by officials (Part 3 of Article 368 as part of the group - Part 3 of Article 28 of the Criminal Code of Ukraine) and interference in automated document flow systems of courts (Part 2 of Article 376-1 of the Criminal Code of Ukraine). The investigation describes not only the digital, but also the "human" component of influence: paid contacts with individual judges, their assistants and staff members, informing about the actions of the investigation, permanent connections in the Pechersk and Shevchenkivsky courts of Kyiv. The family connection of the head of the Pechersk court, Ruslan Kozlov, with Dmytro Borzykh is separately mentioned.
After the resignation of the former head of the KNIISE, Oleksandr Ruvin, the influence on the expert institution, according to sources, remained: the “scheme of buying and selling expertise” continued to operate. Lawyers tried to change the jurisdiction of the proceedings regarding interference with the register, but after new suspicions of planning a bribe, jurisdiction was finally assigned to the NABU, and the cases will be heard by the Supreme Court of Ukraine. According to sources, the proceedings are approaching the final stage.
Context of the connections: Borzykh has long-standing contacts in the military-prosecutorial environment, is familiar with the current Prosecutor General Ruslan Kravchenko, and is also a godfather of the Deputy Head of the SBU Oleksandr Poklad, who, in turn, often visits the head of the OP Andriy Yermak.
